Drafting of Law Decree on the National Oil Spill Contingency Plan (NOSCP)
In alignment with international best practices, the Lebanese Petroleum Administration (LPA) has developed a National Oil Spill Contingency Plan (NOSCP) for Lebanese territorial waters.
To provide this plan with a binding legal framework and executive authority, JUSTICIA has drafted a law decree defining the roles and responsibilities of entities involved in its implementation. The decree ensures a coordinated, timely, and effective response to oil spill incidents by establishing clear mandates for governmental bodies, non-governmental organizations, private sector stakeholders, and international partners. It fosters inter-agency cooperation and resource integration to address environmental emergencies efficiently.
Key provisions of the decree include mechanisms to:
- Ensure prompt and effective oil spill responses and pollution prevention;
- Identify national high-risk and priority coastal areas for protection and clean-up;
- Facilitate cross-border cooperation and mutual assistance with international bodies.
The law decree covers oil spill response in Lebanon’s Public Maritime Domain, including the Territorial Sea and Exclusive Economic Zone (EEZ), and addresses incidents originating from transboundary sources entering the Lebanese EEZ.
Restriction of Military Courts’ Jurisdiction and Strengthening the Enforcement of Administrative Court Decisions in Lebanon
The Lebanese military judiciary currently wields broad jurisdiction, which has prompted concerns regarding fair trial standards. Two primary issues are its jurisdiction over civilians and its inconsistency with principles of transparency, impartiality, and equality before the law.
Comparative analysis with Egypt and Jordan has informed JUSTICIA’s recommendations—supported by the Konrad-Adenauer-Stiftung Foundation—toward reforming Lebanon’s military justice system. The proposed reforms advocate for a military judiciary model that ensures independence and impartiality while upholding defense rights and transparent legal reasoning.
In parallel, JUSTICIA has also tackled the weak enforcement of rulings issued by the Lebanese Administrative Court (State Council). With support from the Konrad-Adenauer-Stiftung Foundation, a comprehensive study and program were initiated to analyze the court’s structure, enforcement mechanisms, and recent jurisprudential developments.
Effective enforcement is critical to maintaining the rule of law—especially in holding public institutions accountable. Challenges persist in implementing rulings against government agencies, as demonstrated by the 18 September 2014 pledge by the Prime Minister to enforce the court’s decision regarding more than 600 Lebanese detainees in Syrian prisons since the 1970s.
Further undermining judicial authority, over 35 rulings related to public sector appointments remain unenforced. This ongoing disregard for the Administrative Court’s decisions contradicts the principle of judicial independence, particularly given the court’s dual role as both legal advisor and adjudicator on administrative matters. Reforming enforcement procedures is essential to guarantee judicial effectiveness when rulings involve public entities.
KNOW YOUR RIGHTS: Legal Awareness for All
The KNOW YOUR RIGHTS initiative aims to empower Lebanese citizens by clarifying legal rights and responsibilities, particularly in a complex and often inaccessible legal system. Equal protection under the law presumes public awareness—but in Lebanon, legal complexity and limited access to legal counsel disproportionately affect the lower and middle classes.
The principle of ignorantia juris non excusat (ignorance of the law is no excuse), and its Latin counterpart nemo censetur ignorare legem (no one is deemed ignorant of the law), presume that laws are publicly accessible and widely disseminated. However, the vast and often opaque legislative process in Lebanon hinders this presumption, especially for those without legal training.
